These Level Visa Card Authorized User Terms (“Level Card Terms”) are an agreement between Level Benefits, Inc., a Delaware corporation doing business as Level (together with its affiliates, “Level”, “we,” “us,” and “our”) and you, as a user of the Level Visa Card (“you,” and “your,” and together with Level, the “Parties”).
The Level Visa Card (“Level Card”) is issued by The Bancorp Bank, N.A. (“Issuer”), a nationally-chartered bank, together with its affiliates, pursuant to a license from Visa U.S.A. Inc. Level is the program manager for the Level Card.
By using or activating the Level Card, you agree to these Level Card Terms and all other terms, policies and guidelines applicable to all Level’s services (“Services”), including the Level Platform Terms of Service, Member Terms and Privacy Policy (collectively, the “Terms”). Capitalized terms not otherwise defined in these Level Card Terms will have the same meaning set forth in the Terms. To the extent that there is any inconsistency between these Level Card Terms and other provisions in the Terms, these Level Card Terms shall control with respect to the Level Card.
Level Authorization. Level authorizes you to use the Level Card to pay for Qualified Expenses in accordance with the Terms. You may not use the Level Card for any purpose other than paying for Qualified Expenses. Level may revoke your authorization to use the Level Card and/or disable your ability to use the Level Card without any notice, at any time and for any reason.
User Responsibility. Each Level Card transaction that you initiate or authorize constitutes your affirmation that the Level Card is being used to pay for Qualified Expenses, and your request will reduce your available limit for Qualified Expenses by the amount of the transaction and any applicable fees. You are responsible for all transactions you initiate or authorize, including any and all fees you incur while using the Level Card. You are responsible for ensuring that all use of the Level Card, including but not limited to any use by someone who is your dependent, as that term is defined by Section 152 of the Internal Revenue Code (“Dependent”) or any other person you permit to access the Level Card, complies with the Terms and all applicable laws, rules and regulations.
Qualified Expenses Limit. You are responsible for keeping track of your available limit for Qualified Expenses, which you may view through the Level App or our website www.level.com. You may not initiate any transaction that exceeds your available limit for Qualified Expenses. You are liable for any transactions that exceed your available limit for Qualified Expenses and must immediately reimburse Level for the amounts of such transactions and any associated fees. We endeavor to ensure that your available limit for Qualified Expenses is current, but there may be delays in transaction processing times and records, so your available limit for Qualified Expenses as displayed in the Services may not always be current.
Repayment. If you fail to repay the amount of any improper or excessive transaction, you agree that, to the fullest extent permitted by law: (i) your Employer will be entitled to withhold the amount of the improper payment from your pay or other compensation, (ii) a relevant benefit plan may offset the unreimbursed amount against future claims, (iii) you will be liable to us for any fees, charges, costs, amounts, expenses or other losses that result from your actions or inactions associated with use of the Level Card, and (iv) you will pay Level the reasonable costs and expenses of collection of any amounts due from you under the Terms.
Using PIN. If you have been issued a prepaid card, certain merchants may request the input of a PIN via the secondary network, STAR. You may be able to bypass this by selecting the applicable options at the terminal in most cases. If you are unable to do so, please reference your PIN number by chatting into support (“what is my PIN”) or searching for PIN in the help articles. Please note, you will not be able to change your PIN as it is automatically generated. You should not write or keep your PIN with your Card. Never share your PIN with anyone. When entering your PIN, be sure it cannot be observed by others and do not enter your PIN into any terminal that appears to be modified or suspicious. If you believe that anyone has gained unauthorized access to your PIN, you should advise us immediately.
Use by Other Persons. If you permit another person to have access to the Level Card, we will treat this as if you have authorized use of the Level Card, and you will be liable for all resulting transactions and fees incurred. You are responsible for safeguarding the Level Card to prevent use of it by a person: (i) who is not you or your Dependent, (ii) who does not have actual, implied or apparent authority from you to use the Level Card, and (iii) whose use does not result in a direct or indirect benefit to you or your Employer (“Unauthorized Use”). These responsibilities include safeguarding the Level Card’s account numbers and its security features such as its security code.
Lost or Stolen Level Cards. If the Level Card is lost or stolen, or if there is possible Unauthorized Use, you must notify Level Support immediately through the Level App or our website www.level.com within the first 24 hours following discovery of the loss, theft or possible Unauthorized Use. If (i) notice as described in this section is given within the first 24 hours, and (ii) you assist Level in investigating the facts and circumstances relating to the loss, theft or possible Unauthorized Use of the Level Card, then you may not be liable for transactions that we determine to be the result of Unauthorized Use.
Merchant Driven Holds. When you use the Level Card at hotels, restaurants, gas stations, rental car companies or certain other merchants, they may require us to place a hold on the Level Card for an amount that exceeds the final transaction amount. Your available limit for Qualified Expenses will be reduced in the amount of the hold, until the hold is released.
Transactions Outside of the United States. Although we only make the Level Card available to persons residing in the United States, you may use the Level Card for Qualified Expenses everywhere Visa Network branded payment cards are accepted, in accordance with limitations set forth in the Terms. The same applies to the secondary network, STAR, where applicable.
Denial of Requested Transactions. An initiated transaction may be denied authorization for any reason, including but not limited to if: (i) the type of merchant requesting the authorization is not a merchant type that is allowed to accept the Level Card, (ii) the amount of the proposed transaction, together with the amount of your outstanding transactions if any, exceeds your available limit for Qualified Expenses, (iii) the amount of the proposed transaction, together with your outstanding transactions, would cause you to exceed any authorization limit set by Level, (iv) the Level Card has been restricted, canceled, suspended, or terminated, (v) we believe that the transaction is not a payment for Qualified Expenses, or (vi) we believe that authorizing the transaction would create risk of (a) fraud or other harm, (b) a violation of the Terms or a payment card network rule, (c) a violation of applicable law, or (d) a violation of a regulatory obligation. We are not responsible for losses resulting from declined authorizations or reversed transactions.
Restricting, Suspending and Terminating the Level Card. We may partially or wholly restrict your ability to use the Level Card in any manner and suspend or terminate your authorization or ability to use the Level Card, for any reason, at any time without any notice. For illustration purposes and without limitation we may take these actions if: (i) your Employer fails to comply with its obligations relating to its participation in the Level Card program, (ii) you fail to pay any amounts owed to Level, (iii) we determine that there is Unauthorized Use, (iv) you are no longer eligible for Qualified Expenses in whole or in part, or Level no longer offers the benefits plan(s) or company expense program associated with the Level Card, (v) upon Level’s request, you fail to provide documentation sufficient to substantiate a Qualified Expense, such sufficiency to be determined by Level in its sole discretion, (vi) we believe the action(s) is necessary to address risk of (a) fraud or other harm, (b) a violation of the Terms or a payment card network rule, (c) a violation of applicable law, or (d) a violation of a regulatory obligation, or (vii) we believe that there has been a violation of the Terms.
Merchant Disputes. We will have no liability if any merchant does not honor the Level Card, if a merchant is unable to obtain an authorization with respect to any transaction you initiate, or if you use the Level Card to pay for anything other than Qualified Expenses. We are not responsible for the quality, safety, legality, or any other aspect of any goods or services you purchase with the Level Card. Any Merchant disputes, returns, or refunds must be addressed and handled directly with the merchant from whom the transaction posted or those goods or services were provided.
YOU RELEASE LEVEL. To the fullest extent permissible under applicable law, you release us from any claims of damages, losses or other liability that you have or that you may incur as a result of: (i) any declined authorization or reversed transaction, even if your actual available limit for Qualified Expenses at such time was sufficient to support the authorization or transaction, (ii) completing or failing to complete a transaction, (iii) any restriction, suspension or termination of your authority and/or ability to use the Level Card, and (iv) any claims of damages, losses or other liability that you may have or that you may incur as a result of any merchant dispute return or refund.
Cancellation. You may cancel the Level Card through the Level App or our website www.level.com. You will continue to be liable for all transactions on the Level Card occurring prior to any cancellation, suspension or termination of it. If the Level Card is canceled, suspended or terminated, you may not use the Level Card to perform, or permit or authorize anyone else to perform any further transactions. If any transactions are performed after cancellation, suspension or termination, you will still be liable and responsible under the Terms for any transaction made by you or anyone authorized by you and you agree to promptly reimburse Level for any such transactions, fees and overages.
Support. You may use the Level App to manage the Level Card, your profile and review recent transactions. For additional assistance and frequently asked questions, please refer to www.level.com/help. Level Support is available Monday through Friday 9:00 AM to 9:00 PM EST.
Card Expiration and Replacement. The Level Card will expire on the date printed on it. If you need to replace the Level Card for any reason, please request a replacement through the Level App.
We operate a compliance program for the Level Card that is designed to: (i) prevent terrorism and money laundering activities, (ii) fulfill our legal and regulatory obligations, and (iii) prevent fraud, other harm and illegal activity. You understand and agree that, in order to administer our compliance program we must obtain, verify, and record information that identifies you and all information pertaining to your use of the Level Card and our platform. You agree to keep your identification information current with us. You represent and agree that you are not currently and will not become subject to a U.S. Office of Foreign Asset Control list, or any other law, regulation, or other list of any government agency that prohibits or limits us from permitting you to use the Level Card or from otherwise conducting business with you.

These Level Card Terms do not establish an express, implied or quasi contractual relationship between you and us nor do these Level Card Terms establish an express, implied or quasi customer relationship between you and us.

The Level Card and your obligations under these Card Terms may not be assigned. We may transfer our rights under these Card Terms. Use of the Level Card is subject to all applicable rules and customs of any clearinghouse or other association involved in transactions.
